NLRB Issues Significant Decisions in Recent Weeks / Significant ...

The National Labor Relations Board this week made public a number of significant decisions, most reached in the final days of the term of Member Brian Hayes, which ended on December 16. The Board continues with three members, Chairman Mark Gaston Pearce and Members Richard F. Griffin, Jr. and Sharon Block.

The decisions touch on a variety of issues including social media postings, charter school jurisdiction, backpay awards, the chargeability of certain union lobbying expenses, and an employer?s responsibility to continue dues collection after the expiration of a contract.

Most of the cases were decided the week of December 10, but were issued this week following editing and formatting, which is typical for the final decisions in a Member?s term. Brief descriptions to the decisions follow.

Hispanics United of Buffalo ? The Board found that the employer unlawfully fired five employees because of their Facebook posts and comments about a coworker who intended to complain to management about their work performance. In its analysis, the Board majority applied settled Board law to the new world of social media, finding that the Facebook conversation was concerted activity and was protected by the National Labor Relations Act. Member Hayes dissented.

Alan Ritchey, Inc. ? In a unanimous decision that resolved the last of the two-member cases returned following the 2010 Supreme Court decision in New Process Steel, the Board found that where there is no collectively-bargained grievance-arbitration system in place, employers generally must give the union notice and an opportunity to bargain before imposing discipline such as a discharge or suspension on employees. Member Hayes was recused.

Latino Express ? In a decision that will affect most cases in which backpay is awarded, the Board decided to require respondents to compensate employees for any extra taxes they have to pay as a result of receiving the backpay in a lump sum. The Board will also require an employer ordered to pay back wages to file with the Social Security Administration a report allocating the back wages to the years in which they were or would have been earned. The Board requested briefs in this case in July 2012. Member Hayes did not participate in the case.

Chicago Mathematics & Science Academy ? Rejecting the position of a teachers? union, the Board found that it had jurisdiction over an Illinois non-profit corporation that operates a public charter school in Chicago. The non-profit was not the sort of government entity exempt from the National Labor Relations Act, the Board majority concluded, and there was no reason for the Board to decline jurisdiction. Member Hayes dissented in part.

United Nurses & Allied Professionals (Kent Hospital) ? The Board, with Member Hayes dissenting, addressed several issues involving the rights of nonmember dues objectors under the Supreme Court?s Beck decision. On the main issue, the majority held that, like all other union expenses, lobbying expenses are chargeable to objectors, to the extent that they are germane to collective bargaining, contract administration, or grievance adjustment. The Board invited further briefing from interested parties on the how it should define and apply the germaneness standard in the context of lobbying activities.

WKYC-TV, Gannet Co. ? Applying the general rule against unilateral employer changes in terms and conditions of employment, the Board found that an employer?s obligation to collect union dues under a check-off agreement will continue after the contract expires and before a bargaining impasse occurs or a new contract is reached. Member Hayes dissented.

What drinks do you consider festive? Champagne cocktails? Mulled apple cider? Mulled wine? Hot Toddy?

Having tried to convince people to ?eat? their eggnog as ice cream, we?re not surprised. Eggnog is a divisive Christmas treat, much liked fruit cake.

Having done a hot chocolate roundup of Ottawa this December, we understand the spicy hot chocolate and churros suggestion. Really, we do!

Now, would you consider another cocktail; something that is decidedly Canadian? Would you consider the mighty Caesar this holiday season?

Combining vodka with something savoury and flavouring it with Worcestershire and chiles has its roots in the British bullshot, which is itself a variant of the bloody mary (the drink, not the conjured spirit).

A bloody mary is considered a ?complex? cocktail as it mixes together vodka, tomato juice, beef consomme (sometimes bouillon), Worcestershire sauce, pepper sauce (vinegar-based hot sauces like Tabasco), horseradish, chiles, and lemon juice. It is garnished with a slice of citrus and/or a rib of celery.

A bullshot includes no tomato juice, just beef consomme. It is usually served warm.

A Caesar (or bloody Caesar) substitutes ?Clamato? for tomato juice and beef consomme. Clamato is a mixture of tomato juice and clam broth, which is retailed by Mott?s. Both Clamato and Caesars are most popular in Canada.

This year, Mott?s approached me to provide them with a holiday tip, which they asked me to explain on camera to their ?Caesar Mixing Officer? (CMO), Clinton Pattemore (@CaesarClint). I chose the beloved subject of stuffing and how to accommodate guests with dietary restrictions.

An accomplished mixologist who teaches mixology, Pattemore made me my first Caesar on set, albeit a virgin one. It was tasty.

That same week, Claire, our wine blogger, gave me permission to come up with a drink for her upcoming housewarming party, which Jenn and I proceeded to miss due to unforeseen circumstances. When Claire entertains, she only expects her guests to come with a smile and may be some bubbly. Now, her then new Beau (now her fianc?) is Jewish. Naturally, I decide to try my hand at making bacon vodka and my own take on the Caesar. I even asked Pattemore for tips.

Eventually, I approached Bethann McLaren (@tasket), bartender at Chef Patrick Garland?s Absinthe Cafe (1208 Wellington Street W.), for guidance. Absinthe Cafe is well regarded for its cocktails by peers in the industry. Mark Warburton, founder of a local foodie forum Ottawa Foodies and an amateur cocktail artist, calls McLaren a cocktail genius.

She recommended making my own ?Clamato?, the key being chiles (including chipotle), cayenne, and black pepper. McLaren makes hers by instinct, employing an immersion blender. She even suggested straining the pulp, dehydrating it, grinding it into powder, mixing in some crisped bacon, and using the mixture as ?rimmer.?

Following both Pattemore and Mclaren?s advice, Jenn and I picked up some value-oriented ($7.40/200 mL) Polar Ice vodka (4-times distilled) and Seed to Sausage smoked bacon. Meat maestro Mike Mckenzie (@seed_to_sausage) and his team at the Sharbot Lake-based salumeria now make bacon for local grocery chain Farm Boy. We picked up a package of Molasses Black Pepper bacon the first week it was available.

How does one make bacon vodka? Purchase some quality sliced bacon. Place the rashers on a rack over a pan in a cold oven. Set a timer to an hour and turn the oven to 400 F. Roast the bacon until much of the fat has rendered out. Check the bacon after 45 minutes for doneness. When the bacon crisps, remove it from the oven and dab the strips with a clean tea towel (or paper towel). Let the bacon cool.

Pour the vodka into a lidded container. We used a wine decater. Add the bacon. Lid the container and place it in the fridge. Let the bacon infuse anywhere from 4 days to 2 weeks. Afterward, strain the vodka, which will have taken on a yellow tinge, through a funnel, lined with a coffee filter paper. This last step removes excess bacon drippings and any residual particulate matter.

Bacon vodka contributes a few bacony notes and distinct smokiness to mixed drinks.

Bacon Rimmer
Rimmer is a mixture of salt and spices that is used to coat the rim of glasses. While you can purchase prepared rimmer from Mott?s, which is laced with mono-sodium glutamate (MSG), it is easily made at home. The following, for instance, is a spicy rimmer, laced with bacon.

What You?ll Need:

  • 2 tbsp whole black peppercorns
  • 2 tsp red chile flake
  • 1/4 cup kosher salt
  • 1/2 tsp cloves
  • 3 rashers of crisped bacon

Prep:

  1. Finely chop the crisped bacon and place it in a metal bowl.
  2. Crack the peppercorns with a mortar and pestle or a tea towel, a cutting board, and a heavy pot. Placed the cracked pepper into the bowl with the bacon.
  3. Grind the cloves into powder. Add it to the bowl with the bacon.

Method

  1. Mix together the chopped bacon, cracked pepper, ground cloves, chile flake, and salt and place everything onto a plate.

Classic Caesar
According to labels on bottles of Mott?s Clamato, Caesars are made by first rimming highball glasses with rimmer.

This can be done by gently dampening a tea towel; placing the open end of a glass onto the towel; and placing the glass into plated rimmer.

Alternatively, rim the glass with a wedge of lemon and place the lemon-coated end into plated rimmer.

Then, fill the rimmed glass with ice and add 1 ? 1 1/2 oz of vodka (or bacon vodka). Add 4-6 oz of Clamato, 2 dashes of pepper sauce, 2-4 dashes of Worcestershire sauce, salt and pepper to taste, and a squeeze of lemon.

Garnish with a slice of lime and a rib of celery.

Enjoy.

Bullshot-style Caesar
For a bullshot-style caesar, rim a glass. Fill it with ice and add a little less than an oz of bacon vodka. Add 8 oz of tomato beef consomme; 4 dashes of pepper sauce; 2 dashes Worcestershire sauce; salt and pepper to taste; and a squeeze of lemon.

Garnish with a slice of lime and a stalk of lemongrass.

Personally, I think a bullshot-style Caesar tastes best warm. So, omit the ice and bring the consomme to a simmer in a non-reative pot set to medium heat. Take it off the heat and add chilled bacon vodka. The vodka will bring the temperature of mixture down to something drinkable.

Why is there nothing nearly as festive as a Caesar? There are two reasons: Firstly, this drink, served hot or chilled, can warm you inside-out. It may have something to do with the spices. It may have something to do with the vodka. Caesars taste almost healthy! Secondly, look at the colours, red and green. Caesars are already decorated for Christmas!

Side Notes

Tomato Consomme
To make a tomato beef consomme, simmer 3 cups of clarified beef broth (or stock) with 1 tsp of black peppercorns, 1 small white or yellow onion, 8 cloves, 2 star anise pods, and a 5? stalk of cinnamon for 2 hours.

Then, finish the consomme by adding 4 tbsp of tomato paste and strain the mixture through a fine mesh seive or chinoise.

If you would like more distinct spice flavours, dry roast the dried whole spices beforehand.

Easy Bacon
The bacon we used for the rimmer is something we make using raw sliced pork belly. We call it ?easy-bacon.?

What You?ll Need:

  • 1 lb of sliced pork belly
  • 4 cups of water
  • 1/4 cup kosher salt
  • 1/4 cup raw sugar (or brown sugar)
  • 1 tbsp black peppercorns
  • 1 tsp juniper berries
  • 2 whole star anise pods
  • 6 dried chiles

Prep:

  1. Place a non-reactive pot set onto medium heat and add the water.
  2. When the water starts to simmer add all of the ingredients except the pork belly.
  3. Bring the mixture back up to a simmer and simmer for 5 minutes.
  4. Take the pot off the heat and let the brine cool to room temperature.
  5. Brine the pork belly in the mixture for 4 hours or overnight, refrigerated.

Method:

  1. Remove the pork belly slices from the brine and dab with a clean tea towel (or paper towel) to dry.
  2. Treat the slices as you would raw rashers of bacon.
    • Place the slices on a rack over a pan in a cold oven.
    • Set a timer to an hour and turn the oven to 400 F.
    • Roast the slices until much of the fat has rendered out.
    • Check the bacon after 45 minutes for doneness.

Because the bacon is unsmoked, besides rimmer, it also makes a nice spaghetti carbonara.

Over the years I have heard many stories of greedy?Grinch?trying to steal someones Christmas. It makes me so sad! Well we can all?thwart?the?Grinch?with being aware of our own home security. We all get busy in the rush of holiday shopping, friends and family visiting and taking road trips. A few simple but often?forgettable?things can help decrease your odds of Grinch deciding your home will be his next target.

Remembering to lock doors and windows before you go out shopping, even if its for a quick trip to the store. Leaving a light on while your out to let it appear someone is there. Turn off your Christmas tree lights and be sure to close the blinds. Open blinds letting your Christmas tree be seen is beautiful but also a lure to a greedy Grinch.?

Leaving the porch light on is another small but sometimes?forgettable?thing that can help keep your home less of a target. Having motion activated exterior lights is also a good idea. If you are planning to go on a trip have your neighbors gather your mail and newspaper. Don't forget to lock the doors that lead to your home from the garage. I often have forgotten that one myself. A garage can be easier to get into and if your home door is lock often the Grinch can't get further than your garage.?

In the delight of the Holiday season just be sure to be take a few extra steps to make sure you have a bit more home?security.

One week after Sandy Hook shooting, a simple remembrance

On Friday in Newtown, Conn., Gov. Dannel Malloy and local officials bowed their heads, and a bell tolled 26 times. The moment of silence was repeated at the White House and in 29 states.

Connecticut Gov. Dannel Malloy (D) and local officials stood on the portico of Newtown?s Edmond Town Hall on Main Street. At 9:30 a.m., the time of the shooting, they bowed their heads, and a church bell from the nearby Trinity Episcopal Church tolled a somber 26 times, once for each of the victims at Sandy Hook Elementary School. Then, no speeches, no reading of victims? names, no posing for the scores of camera crews. Instead, everyone turned around, went back inside the building, and hugged one another.

The moment of silence was repeated at the White House and in 29 states. Workers bowed their heads in public offices in New Jersey and Pennsylvania. In Florida, which took time out for the victims, Lake Eola?s fountain in Orlando shone in green and white lights ? the colors of the elementary school. And websites ranging from AOL and Huffington Post to ESPN and Duke University all went dark at 9:30, responding to a call from webmomentofsilence.org.

In Colorado, Denver Archbishop Samuel Aquila asked Catholic schools and parishes to observe the moment of silence, and he asked that parishes with the capability ring their church bells 26 times.

The moment of silence in Newtown was somewhat similar to the way New York City has memorialized the victims of 9/11, with six moments of silence beginning at 8:46 a.m. (when the first plane hit the World Trade Center). But there is also a reading of the victims? names.

In Newtown, a drenching rain, along with gusty winds, did not stop residents from coming to the ceremony.

Edie Hardwick of nearby Middlebury said she came because she was hoping that ?I can help somebody.?

Wearing an MIA/POW jacket, Ed Pray said he just felt he had to be there. ?It was a pit-in-the-stomach kind of thing,? he says. As for the rain, he saw something good in that as well. ?The rain is cleansing us,? he said.

The travel industry has undergone severe disruptions in the past decade with the ever-changing face of online distribution, where sites like Expedia, Orbitz or Priceline now play pivotal roles in the travel purchase decision model. In this context, social media gains influence before, during and after the travel experience, whether it?s done through posting pictures on Facebook while at the resort, or commenting and sharing hotel reviews via Tripadvisor after the trip.

In 2013, travel brands are facing the next paradigm shift, which has been brewing over the past two to three years: the mobile revolution.

MOBILE, A KEY DRIVER IN DIGITAL TRAVEL GROWTH

According to a recent report from emarketer, total spending on online travel is expected to reach over $120 billion by the end of 2012 and should reach close to $129 billion by end of 2013, a yearly growth of 8%. In 2012, it is estimated that 16 million Americans will have booked travel via a mobile device. By 2016, this number is expected to more than double to 36.7 million!

During this same time period, significantly more mobile users will not only purchase travel on their phones or tablets but also research their next destination, hotel or event through their device. People use their devices at hand to dream of their next trip, and this is where opportunities abound for travel marketers around the world in order to reach potential customer upstream, while they are still in aspirational research mode. In a study conducted this past November by Expedia MediaSolutions and ComScore, 2 in 3 mobile device owning travelers admitted to travel dreaming at least once a month or more!

FROM SOLOMO TO MOBILE-ONLY

One of the biggest etourism trends of 2012 was the rise of solomo, the convergence of social, local and mobile. Social and mobile are a natural fit: simply consider that 58% of all Facebook users access their account through a mobile device. In fact, social media represents the second most popular activity on mobile devices, after internet access, according to a survey conducted by O2 in the United Kingdom during the summer of 2012. Mobile users spend on average more than 17 minutes per day browsing and interacting through their various social accounts. What about local?

Geo-localization applications like Foursquare have been fighting hard to make their way and gain massive adoption, with limited success so far. At first a gaming application, where users could earn badges after so many check-ins at a given location, Foursquare has morphed into a full-fledged application to discover things to do, eat or see once in a given destination. Thus, mobile becomes a way to find new restaurants, according to peer reviews and comments left by friends from your network. OpenTable or Yelp are similar applications, and then there is Google also playing in this sphere, especially since it acquired the online travel agency ITA, restaurant reviews from Zagat and travel publisher Frommers.

There are some, however, who believe mobile is much more than a channel and that it therefore deserves a core focus in the overall travel marketing strategy. Already, Google estimates that 25% of all travel-related searches are conducted via a mobile device, a figure that reaches 33% of searches specifically for accommodations. And looking at this chart taken from a Google study conducted in August 2012, the percentage is even higher when observing behaviors among leisure and business travelers. So it won?t be a stretch before we see things evolving from a ?mobile-first? mentality to a ?mobile-only? approach in the near future.

More Travelers Use Mobile for Travel Information

REAL-TIME & LAST-MINUTE ARE THE NEXT BATTLEFIELD

Whether it is for holiday packages, airfares or hotel and accommodations, more and more searches are now made last minute, which equates in most cases to mobile devices. Major online travel agencies have all developed sophisticated applications and mobile-friendly sites in order to capture this new reality, where estimates vary between 10-30% of all online bookings.

New players are entering the field, such as HotelTonight, a mobile application offering last-minute hotel deals providing up to 70% discounts for same-day reservations. Hotels dump their unused inventory, while mobile travelers take advantage of last-minute deals, a win-win situation, right? Not everyone agrees, as some hotel industry experts believe mobile channel should never be discounted, in particular when bookings are last-minute. The law of offer & demand will prevail, in the end?
